EU Council backs a stronger role for ESMA in cross-border crypto oversight
Council negotiators support more common supervision, with direct oversight focused on the most significant cross-border providers.
Council position
On 9 October 2026 the Council agreed key elements of a negotiating position on the market integration and supervision package.
Crypto oversight
The position would focus immediate direct ESMA supervision on the most significant cross-border crypto-asset service providers, rather than automatically shifting all firms to EU-level oversight.
Not final law
The package still requires negotiations with the European Parliament. Its final provisions may differ from the Council position.
